The following is the contractual document that will govern the purchase of products and services through the website www.miralles1986.es, owned by GUILLERMO CABRERA SL, B – 46297990, with registered office at C/ Barcelonina 3 (46002) València (hereinafter, MIRALLES).
Acceptance of this document implies that the user has read, understands and comprehends what is set forth below, that they have sufficient capacity to contract and that they assume all the obligations undertaken on their part.
- Identity of the parties
On the one hand, Miralles 1986, and on the other hand the user, registered on the website using a username and password, for which he/she has full responsibility for use and safekeeping, being responsible for the veracity of the personal data provided to Miralles 1986.
- Subject of the contract
This contract aims to regulate the contractual relationship of purchase and sale created between Miralles 1986 and the user at the moment when the latter accepts, during the online contracting process, the corresponding box.
The contractual relationship of purchase and sale involves the delivery, in exchange for a price that is determined and publicly displayed through the website, of a specific product or service.
- Procurement procedure
To access the services offered by the provider, the user must register through the website by creating a user account. To do so, the user must freely and voluntarily provide the required personal data.
The user will select a username and password, committing to make lawful and diligent use of them and not to make them available to third parties, as well as to inform Miralles 1986 of the loss or theft of them or the possible access by an unauthorized third party, so that this proceeds to the immediate blocking of the account.
Once the user account has been created, please note that, in accordance with the requirements of Article 27 of Law 34/2002, on Information Society Services and Electronic Commerce, the contracting process will follow these steps:
- Add product to shopping cart by activating the “Add to cart” box.
- Verify the products added to the cart and begin the purchase process.
- Input of user's personal data (email, username and password).
- Billing information and shipping address.
- Selection of transport mode.
- Payment method selection.
- Payment validation.
- Purchase confirmation.
- Applicable guarantees
All products include a minimum 2-year manufacturer's warranty in accordance with the criteria and conditions described in Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws. Users can consult the specific warranties for each product in the technical data sheet. In case of breakage or malfunction of any purchased product, please contact us and we will inform you about the warranty. Warranty services are provided by the product manufacturer, not Miralles 1986.
Furthermore, the user has 14 business days to withdraw from the purchase, as detailed in the section "Right of Withdrawal and Returns". Miralles 1986 is liable for any lack of conformity that may occur within two years of delivery of the product, and the user must report the issue within a maximum of two months of becoming aware of it.
If a product arrives defective at the user's address, Miralles 1986 will proceed, as appropriate, to repair, replace, reduce the price or terminate the contract at no additional cost.
Damage caused by the user that is unrelated to the manufacturing of the products is excluded from the warranty.
- Shipment
Orders will be delivered to the address freely designated by the user within the timeframes specified on the website. Miralles 1986 assumes no responsibility when the delivery of the product or service is not completed due to the user providing false, inaccurate, or incomplete information, or when delivery cannot be made for reasons beyond the control of the assigned shipping company, such as the recipient's absence.
Notwithstanding the foregoing, Miralles 1986 will take the measures required of a diligent merchant to ensure that delivery can be made within the agreed time and, if that is not possible, as soon as possible, to the satisfaction of the sender and the recipient, and therefore no liability can be attributed to Miralles 1986.
Upon delivery of the goods, the buyer must check the contents of the delivery note. Their signature will imply acceptance of the stated contents, and therefore Miralles 1986 will not accept any claims for breach of this agreement.
- Prices and payment methods
All prices shown are fixed prices that include the statutory Value Added Tax (VAT). VAT refunds are not available.
Discount codes, in the case of promotions, can be entered in the shopping cart before finalizing your order. Promotional gifts will be automatically added to the shopping cart.
Payment methods
The payment methods available on the website are as follows:
1) PayPal (includes payment in installments with PayPal, if available)
The user will be able to pay by PayPal, without needing a PayPal account (depending on the provider's availability). By selecting PayPal as the payment method, the user will be redirected to PayPal's secure payment gateway to complete the transaction.
In the event that PayPal offers the user the option to payment in installments or financing, that option will be Subject to approval The terms and conditions established by PayPal, which will be displayed during the payment process, apply. Miralles 1986 is not involved in the approval, terms, or management of the payment plan.
2) Bank card (Stripe)
The user will be able to pay with bank card through the secure payment platform of Stripe. Data communication is carried out via an encrypted connection, and card details are entered directly into the payment gateway. Miralles 1986 does not store or have access to the user's complete card details at any time.
3) Google Pay and Apple Pay (via Stripe)
When available for the user's device and browser, payment can be made via Google Pay o Apple Pay, managed through the secure payment platform of Stripe. The availability of these methods may vary depending on the device configuration, the country, and the provider.
4) Klarna (via Stripe, if available)
The user will be able to pay by Klarna as a payment method offered through the secure platform of Stripe. By selecting Klarna, the user accepts Klarna's terms and conditions and privacy policy, which will be displayed during the checkout process.
Klarna may offer flexible payment options (e.g., deferred or installment payments) subject to approval Automatic evaluation by Klarna. The specific conditions (terms, amounts, and any applicable costs) will be determined by Klarna and communicated to the user during the purchase process. Miralles 1986 has no control over the approval or financing terms offered by Klarna.
Any issues related to payments, installments, due dates or financing must be handled directly with Klarna through their customer service channels.
- Right of withdrawal and returns
The user will have a maximum period of 14 business days from the date of receipt of the product to return it.
For product returns, the product must be in perfect condition and in its original packaging. To exercise the right of withdrawal, the user must send a revocation document to the indicated administrative address or communicate it through any of the contact methods that Miralles 1986 makes available to users.
The refund will be processed within a maximum of 30 days. Regarding return shipping costs, the law stipulates that the consumer is responsible for the cost of shipping the product back to our facilities. The purchase price, minus the return shipping costs, will be refunded once the product has been received and its condition verified. The refund will be issued via the same payment method used by the customer, unless an alternative method is requested.
Products made to the consumer's specifications are not subject to the right of withdrawal.
- Exclusion of the right of withdrawal
The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and whose production has been made to measure in accordance with an individual choice or instruction by the consumer or that are clearly adapted to the personal needs of the consumer.
The right of withdrawal expires early in the case of contracts for the delivery of sealed products that are not suitable for return for health or hygiene reasons if the seal has been removed after delivery.
